The Promoter – (Buncrana Golf Club)
Win A Dream Car under a lottery licence issued by the District Court in Donegal under Section 28 of the Gaming and Lotteries Acts 1956 to 2019. The purpose of the Draw is to raise funds for the benefit of Buncrana Golf Club Donegal. The Draw is undertaken in accordance with these Terms and Conditions (“Terms”) which are binding on all participants in the Draw.
The Prize
The Prize provided is a (car) – valued at a minimum (€30,000.00) as of 1 January 2024. The Prize is does not include Car Insurance or Car Tax. The Prize is not redeemable for cash by the promoter. The Promoter does not accept any responsibility or liability to the winner for any dissatisfaction with the Prize.
The Prize is provided “as is” and the Promoter does not make any representation nor give any warranty in respect of the Prize.
The Raffle Draw
Tickets: one ticket costs €25, 3 tickets for €50 and 7 tickets for €100. Each ticket purchased entitles the bearer entry to the Draw. Persons may purchase more than one ticket. The maximum number of tickets that will be made available is (4,000). The Raffle Draw is open to anyone worldwide, aged 18 or over who has purchased a ticket. In the event a named party to a ticket is under 18 years of age the Promoter shall deal only with their Trustee and the prize shall be conveyed to the Trustee for so long as the Beneficiary is a minor.
Determining the Winners: The Draw is currently scheduled to be held live at Buncrana Golf Club Donegal, on Facebook by an independent adjudicator at 12pm on Saturday, 31st August, 2024. However, the Promoter reserves the right to change the date of the Draw to a different date if all tickets have not been purchased. The drawing of the winners will be independently observed. The winner will be drawn at random and determined based on the name and contact details on the winning ticket (as evidenced by the unique number allocated to the ticket regardless of who paid for the ticket. The first ticket drawn shall be the winner of the prize. The winner, as determined by the Promoter in the presence of the independent observer, will be final and no appeals or correspondence will be entered into.
How to claim
Contacting Winner: The Promoter will use all reasonable endeavours to contact the winner using the contact details provided on the winning ticket. However, if the Promoter is unable to contact the winner within (35) days of the date of the Draw, the Promoter reserves the right to cancel the ticket and select an alternative ticket for the prize. Evidence of identity and age (over 18) that matches the winning ticket will be required before the prize will be awarded.
The Promoter will not enter into correspondence with third parties and will not use alternative contact details to those supplied upon purchase of the raffle ticket. If a winner does not claim the Prize, does not respond within 5 weeks of their details being posted on the website of the Promoter, such winner waives the right to claim the Prize and the Prize will be awarded to the purchaser of the ticket next drawn as noted on the Runners-up list. The winner of the main prize will have to provide a valid driving licence and proof of insurance on collection or be represented by a trustee appointed in writing by them who can provide a valid driving licence and proof of insurance on collection.
Publicity
The purchasers of tickets agree and give consent that, if they win, the Promoter will have the right, without additional payment or permission, to use their name, town of residence and likeness for the purposes of announcing the winner of the Raffle Draw and for related promotional purposes.
The Promoter will retain and use ticket purchasers’ personal data for the duration of the Draw and for a reasonable period thereafter. The winner will be announced within 28 days of the draw by email and/or post and/or Facebook and/or Twitter/X and/or Instagram and/or SMS. It is necessary to publish the name and an image of the winner so that the Promoter can evidence that the Draw has been completed fairly in accordance with these Terms.
If a winner would prefer not to participate in any further publicity after this initial announcement please contact buncranagolfclub@gmail.com and the Promoter will consider any objections in line with data protection law.
Restrictions
Individuals who attempt to circumvent, alter or interfere with the Raffle Draw in any way, will be precluded from benefiting from the Raffle Draw.
If there are reasonable grounds to believe that there has been a breach of these Terms and Conditions by an entrant, the Promoter may, in its sole discretion, invalidate the relevant entry and disqualify the entrant from the Raffle Draw.
Neither the Promoter, nor its employees, officers, trustees, agents, committee members or other volunteers who assist in the Draw accept any responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered as a result of entering the Draw or accepting the prize. Promoters reserve the right to increase the number of tickets sold. The Promoter shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control.
Promoter’s right to modify or cancel
The Promoter reserves the right in its sole discretion to modify or temporarily suspend this Raffle Draw at any time and with no liability to any entrant or any third party.
If the Raffle Draw is not capable of being conducted as specified in these terms and conditions, or in the event of virus, a computer bug or unauthorised human intervention, or any other cause that is beyond the Promoter’s reasonable control, the Promoter reserves the right to substitute the Prize for cash value or for another prize of equal value.
Disputes: These Terms shall be governed by the laws of Ireland and shall be subject to the exclusive jurisdiction of the Irish courts.
